Please read these Terms carefully. By creating an account or using Playdore, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the platform. These Terms constitute a legally binding agreement between you and Playdore.
1. About Playdore & Platform Role
Playdore ("Playdore", "we", "us", "our") is a technology platform and online marketplace that connects individual learners ("Users" or "Learners") with independent activity instructors and service providers ("Instructors") offering classes, sessions, and experiences in categories including dance, sports, music, fitness, wellness, martial arts, and related activities.
1.1 Playdore is a Technology Intermediary — Not a Service Provider
Playdore provides the platform, tools, and infrastructure that enable Users and Instructors to discover one another, communicate, and transact. Playdore is not itself a provider of any activity, class, coaching, or training service. When a booking is confirmed:
- The resulting agreement for the provision of services is formed directly and exclusively between the User and the Instructor — not between the User and Playdore.
- Playdore is a facilitator and technology intermediary. Playdore is not a party to any service agreement between a User and an Instructor.
- Playdore does not supervise, manage, direct, or control the delivery of any session or class by an Instructor.
1.2 Instructors Are Independent Third Parties — Not Employees or Agents
All Instructors on Playdore are independent contractors and not employees, agents, partners, joint venturers, or representatives of Playdore in any manner. This is a fundamental aspect of how the platform operates and carries the following legal implications:
- Playdore has no employer-employee relationship with any Instructor and assumes no vicarious or employer liability for the actions, omissions, conduct, negligence, or misconduct of any Instructor on or off the platform.
- Instructors set their own prices, availability, class formats, cancellation policies, and service terms — these are not determined by Playdore.
- Playdore does not control how Instructors conduct their sessions, the content they teach, or the manner in which they interact with Users.
- Any advice, instruction, guidance, or direction provided by an Instructor during a session is the sole responsibility of that Instructor, not Playdore.
- Nothing in these Terms or in the operation of the platform shall be construed as creating an employment, agency, or franchise relationship between Playdore and any Instructor.
By using Playdore, Users acknowledge and accept this structure and understand that their relationship is with the Instructor for the purposes of any activity they book.
2. Eligibility
2.1 Account Holders
- Playdore accounts may only be created by individuals who are 18 years of age or older.
- By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements under applicable Indian law.
- Instructors must be at least 18 years old and legally authorised to offer the services they list.
2.2 Booking for Minors
- Adult account holders (parents, legal guardians, or authorised caregivers, collectively "Guardians") may book activities on behalf of a child of any age.
- By making such a booking, the Guardian accepts full responsibility for the child's participation and consents to the associated data processing on the child's behalf, in accordance with our Privacy Policy (Section 6).
- Children do not have independent accounts on Playdore. All bookings for minors must be made through a Guardian's adult account.
- Playdore is not responsible for assessing whether any activity is developmentally, physically, or medically appropriate for a child. That assessment rests solely with the Guardian.
2.3 Accuracy of Information
By using Playdore, you represent that all information you provide is accurate, current, and complete, and that you will keep it updated. Providing false information, including a false age, is a violation of these Terms and may result in immediate account termination.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Provide accurate registration information and keep it updated at all times
- Not share your account with others or create multiple accounts for the same person
- Not allow any third party to use your account or credentials
- Notify us immediately at support@playdore.com if you suspect any unauthorised access to or use of your account
You are fully responsible for all activity that occurs under your account, including bookings and payments, whether or not authorised by you. Playdore reserves the right to suspend or terminate accounts that violate these Terms, that are associated with fraudulent activity, or that have been inactive for an extended period, with or without notice.
4. Instructor Listings & Verification Disclaimer
4.1 Instructor Obligations
By listing on Playdore, Instructors agree to:
- Provide accurate, truthful, and up-to-date information about their qualifications, services, pricing, location, and availability
- Complete the identity verification (KYC) process required by Playdore before any listing goes live
- Hold all licences, certifications, or permits applicable to their activity that are required by law or by their relevant professional body (e.g., sports coaching certifications, fitness trainer credentials, music teaching qualifications)
- Not list services that are illegal, unsafe, or violate Playdore's content and community policies
- Honour all confirmed bookings or provide adequate notice and full resolution if unable to do so
- Comply with all applicable laws, including tax obligations, consumer protection laws, and any regulations governing their professional activity
4.2 Instructor Verification Disclaimer
Important — Please Read: Playdore verifies the identity of all Instructors through a government-issued ID / KYC process prior to listing. However, Playdore does not independently verify the professional certifications, qualifications, academic credentials, or training history declared by Instructors on their profiles, unless a specific "Verified" badge has been displayed and earned through Playdore's verification programme (where applicable).
Specifically:
- Identity Verified: All Instructors have submitted government-issued identity documentation (e.g., Aadhaar, PAN) that has been reviewed and verified by Playdore's internal team. This confirms the Instructor's identity — it does not confirm their professional suitability, teaching quality, or the accuracy of their self-declared qualifications.
- Certifications — Self-Declared: Unless a "Verified" or "Certified" badge is explicitly shown on an Instructor's profile, all qualifications, certifications, awards, and experience listed are self-declared by the Instructor and have not been independently confirmed by Playdore.
- Background Checks: Playdore does not currently conduct police verification or criminal background checks on Instructors as a standard part of onboarding. Users who require this level of assurance are encouraged to request relevant credentials directly from the Instructor before booking.
- No Quality Guarantee: Playdore does not guarantee the quality, skill level, suitability, or fitness of any Instructor for any particular purpose or user need. Reviews and ratings from other users provide the primary public signal of Instructor quality.
By booking an Instructor through Playdore, Users acknowledge that they have reviewed the Instructor's profile, reviews, and listing details and are making an independent and informed decision to proceed with the booking.
4.3 Partner Account Types & Document Requirements
Playdore supports two types of Instructor/Partner accounts. The documents required for each type are as follows:
Individual Instructor Account: For freelance instructors, independent coaches, or self-employed professionals operating under their own name:
- Government-issued photo identity proof — Aadhaar card (mandatory) and/or Passport
- PAN card — mandatory for all Instructors who will receive payouts, for tax compliance and TDS processing
- Current residential address proof (Aadhaar with address, utility bill, or bank statement)
- A current photograph for identity confirmation and profile display
- Relevant professional certifications or qualifications — scanned copies or clear photographs of certificates. Submission is required for listing under certification-sensitive categories (e.g., certified fitness trainer, qualified sports coach); optional but encouraged for other categories
- Bank account details (account number, IFSC code, account holder name) for payout processing
Business / Studio Account: For registered entities including companies, LLPs, partnership firms, MSMEs, or studios:
- Legal business name and trade/brand name (if different)
- Business registration proof, as applicable to entity type: Certificate of Incorporation (companies), LLP Agreement + Incorporation Certificate (LLPs), Partnership Deed (partnership firms), Udyam Registration (MSMEs), or Shop and Establishment Certificate (sole proprietorships)
- GSTIN — required for GST-registered businesses; optional for entities below the GST threshold
- Business registered address and operational address
- Identity documents of the primary authorised representative (Director, Partner, or Proprietor) — Aadhaar and PAN
- Any trade licence, municipal permission, or activity-specific regulatory approval relevant to the services offered
- Business bank account details for payout disbursements
Playdore reserves the right to request additional documents beyond those listed above, at its discretion, if it deems additional verification necessary to confirm the Instructor's identity, eligibility, or the legitimacy of their business. Failure to provide requested documents within the timeframe communicated by Playdore may result in the application being placed on hold or rejected.
4.4 KYC Review Process
All Instructor and Partner applications, including submitted documents, are reviewed by Playdore's internal team. Playdore does not currently use a third-party KYC verification vendor. The review process operates as follows:
- Submission: Instructors submit their application and required documents through the Playdore partner onboarding portal or app. Incomplete submissions will not be reviewed until all required documents have been provided.
- Internal review: Playdore's team will review the submitted documents to verify identity, check for completeness and legibility, and assess the application against Playdore's onboarding criteria. Playdore may contact the applicant during this period to request clarification or additional documents.
- Review timeline: Playdore will endeavour to complete the review of a complete application within a reasonable timeframe, typically communicated to applicants during the onboarding process. Timelines may vary based on application volume, the nature of documents submitted, and whether additional follow-up is required.
- Outcome notification: Once a review is complete, the applicant will be notified of the outcome (approval or rejection) via their registered email address and/or through an in-app notification.
- Document security: All KYC documents submitted to Playdore are stored in encrypted form with restricted internal access. Access to submitted documents is limited to authorised Playdore team members involved in the review process.
4.5 Application Rejection and Appeal Process
Playdore reserves the right to reject any Instructor or Partner application at its discretion. Rejections may occur for reasons including, but not limited to:
- Submission of incomplete, illegible, or expired documents
- Evidence or reasonable suspicion of misrepresentation, fraud, or forgery in the application
- The applicant or business being associated with prior violations of Playdore's Terms on a previous account
- The proposed activity being outside Playdore's accepted categories or being assessed as unsafe, illegal, or contrary to Playdore's community standards
- Failure to hold required professional qualifications or licences for the specific category of activity being offered
- Any other reason that Playdore, in its sole discretion, determines makes the applicant unsuitable for listing
Rejection notification: Rejected applicants will be notified via their registered email address. The notification will include the primary reason for rejection (to the extent Playdore is able to disclose this without compromising platform integrity or fraud prevention). Playdore is not obligated to disclose the full details of its internal assessment.
Right to appeal: A rejected applicant may submit a formal appeal within 14 days of receiving a rejection notification, by writing to hello@playdore.com with the subject line "KYC Appeal — [Registered Name / Business Name]". The appeal should include the applicant's reason for contesting the rejection and any additional documentation or clarification they wish to provide. Playdore will review the appeal and respond within 21 days of receipt. Playdore's decision on appeal is final.
Data retention after rejection: Documents submitted as part of a rejected application are retained by Playdore for up to 2 years from the date of rejection for fraud prevention and re-application screening purposes. See our Privacy Policy (Section 10.4) for full details.
4.6 Ongoing Instructor Obligations After Listing
Approval of an Instructor's application and activation of their listing does not discharge their obligations on an ongoing basis. Instructors agree to maintain compliance with the following throughout the duration of their active account:
- Document currency: Instructors must ensure that all documents on file with Playdore remain current and valid. Where a document expires (e.g., a certification with an expiry date, a trade licence, or a business registration renewal), the Instructor must provide updated documentation to Playdore promptly and in any event before the document's expiry. Failure to maintain current documentation may result in listing suspension.
- Certification renewals: Where a professional certification requires periodic renewal (e.g., first-aid certification, sports coaching credentials), the Instructor is responsible for obtaining renewals and uploading the updated certificate to their Playdore profile before the previous certificate expires.
- Change of details: Instructors must promptly notify Playdore of any material changes to their circumstances, including: change of business structure or legal entity, change of primary authorised representative, change of registered business address, change of bank account for payouts, acquisition or loss of a required licence or certification, or any legal proceedings or regulatory actions that may affect their eligibility to operate on the platform.
- Accuracy of listings: Instructors are responsible for keeping their listings, pricing, availability, venue information, and class descriptions accurate and up to date at all times. Misleading or outdated listing information is a violation of these Terms.
- Tax compliance: Instructors are solely responsible for fulfilling their own tax obligations, including income tax filings, GST registration and returns (where applicable), and any other statutory obligations arising from their earnings on the platform.
4.7 Instructor Account Suspension and Termination
Playdore may suspend or permanently terminate an Instructor's account at its discretion in the following circumstances:
- Violation of any provision of these Terms, including the Code of Conduct (Section 10), Anti-Circumvention clause (Section 9), or any other applicable section
- Submission of false, fraudulent, or forged documents during onboarding or at any subsequent point
- Failure to maintain required licences, certifications, or insurance applicable to their listed activities
- Receipt of repeated or serious complaints from Users regarding the safety, conduct, or quality of sessions
- Any legal proceeding, regulatory action, or criminal charge that, in Playdore's assessment, makes the Instructor unsuitable to remain listed on the platform
- Non-payment of applicable platform plan fees or commission balances owed to Playdore
- Extended inactivity — no bookings, listing updates, or logins for a prolonged period, as defined in Playdore's operational guidelines
Where an account is suspended (rather than permanently terminated), Playdore will notify the Instructor with a reason and, where the issue is remediable, allow a defined period to rectify the matter before the suspension becomes permanent. Instructors may appeal a suspension or termination decision by writing to hello@playdore.com within 14 days of notification. Upon permanent termination, any pending payout balance will be processed after deducting any amounts owed to Playdore and after resolution of any open disputes. Playdore shall not be liable for any loss of income, reputation, or business arising from an account suspension or termination.
5. Bookings
When a User books a class or session through Playdore:
- A confirmed booking constitutes a direct service agreement between the User and the Instructor — Playdore is not a party to that agreement.
- Playdore acts solely as a technology intermediary that facilitates discovery, communication, and payment processing.
- Users are responsible for reviewing the class details, location, duration, cancellation policy, intensity level, and any prerequisites before confirming a booking.
- Bookings for children must be made by a Guardian in accordance with Section 2.2 above.
- Playdore does not guarantee that any Instructor will be available at a particular time or that a listed class will remain available after a booking is made in the event of an Instructor-side cancellation.
6. Payments, Fees & Taxes
6.1 Payment Processing
All payments on Playdore are processed through trusted third-party payment gateways, currently including Razorpay and/or Stripe. By making a payment on the platform, you also agree to the applicable terms and privacy policies of the relevant payment gateway. Playdore does not store your card details, UPI credentials, or net banking information — see our Privacy Policy (Section 2.2) for details.
6.2 Pricing and What You Pay
The total amount charged to a User for a booking consists of the following components:
- Class / Session Fee: The price set by the Instructor for the activity, as displayed on the listing page.
- Platform Convenience Fee: Playdore charges a convenience fee per booking as a charge for use of the platform's technology, discovery, and payment infrastructure. This fee is not fixed and may change from time to time. The current applicable fee is always published at playdore.com/pricing and will be clearly displayed at the checkout / booking confirmation screen before any payment is made — you will never be charged a convenience fee that was not shown to you at checkout. Playdore will provide reasonable advance notice of any changes to the convenience fee via in-app notification or email. Continued use of the platform after a fee change takes effect constitutes acceptance of the updated fee. This fee is non-refundableregardless of the outcome of the booking, except where the cancellation is due to Playdore's own fault or technical error.
- Taxes (GST): Playdore is registered under the Goods and Services Tax (GST) framework and charges GST only on its own platform charges — specifically, on the Platform Convenience Fee described above. GST at the applicable rate (currently 18% for platform/technology services) will be levied on the convenience fee and will be shown at checkout. Playdore issues a GST-compliant receipt for its own charges. GST on the Class / Session Fee (the Instructor's portion) is the Instructor's own responsibility — see Section 6.6 for the full breakdown of how GST applies to the marketplace transaction.
All prices are listed in Indian Rupees (INR) unless otherwise stated. Playdore reserves the right to change the convenience fee amount at any time, with reasonable notice, provided the new fee is displayed clearly before any booking is confirmed.
6.3 Instructor Commission
Playdore charges Instructors a commission on bookings made through the platform. This commission is Playdore's primary revenue model and is subject to the following terms:
- Commission Structure: Commission may be charged as a percentage of the booking value (e.g., a fixed percentage of each class fee collected), as a flat fixed fee per booking, or as a combination of both — depending on the Instructor's plan, category, or agreement with Playdore. The applicable commission model and rate will be communicated to each Instructor at the time of onboarding and will be visible in the Instructor's dashboard at all times.
- Commission Rates Are Not Fixed: All commission rates, structures, and applicable tiers are subject to change from time to time at Playdore's discretion. Commission rates are not guaranteed to remain constant for any period. The current partnership tiers and commission rates are published in the Partnership Tiersdocument. Instructors will be notified of any changes to their applicable commission in advance — either via email, in-app notification, or through their Instructor dashboard — with reasonable prior notice before the change takes effect. Continued use of the platform after the effective date of a commission change constitutes acceptance of the revised rate.
- Separate Communication: Specific commission rates, promotional rates, and any category-specific or plan-specific commission schedules will be communicated to Instructors separately (via the Instructor's onboarding documentation, dashboard, or direct communication) and may differ between Instructors based on listing category, booking volume, plan type, or Playdore's commercial agreements. In all cases, the most up-to-date rates are available in the Partnership Tiers document.
- Net Payouts: Net earnings disbursed to Instructors represent the booking amount received, less Playdore's applicable commission, less any applicable TDS (Tax Deducted at Source) withholding, and less any chargebacks, refunds, or dispute adjustments related to the Instructor's bookings.
- Payout Schedule: Earnings are disbursed to the Instructor's registered bank account on Playdore's standard settlement cycle. The standard settlement cycle is every Monday following the start date of the Learner's booking.
- Pre-Start-Date Refunds: If a refund is issued to a Learner before the start date of their booking, the corresponding payout amount will be deducted from the Instructor's upcoming payouts or must be refunded by the Instructor to Playdore.
- Payout Holds: Playdore reserves the right to withhold or delay a payout if there is a pending dispute, suspected fraudulent activity, unresolved compliance requirement, or any other matter that Playdore, in its sole discretion, determines warrants further review before disbursement.
- Payout Holds and Cancellations for Booking Non-Fulfilment: Playdore places significant importance on Instructors honouring their confirmed bookings. Where an Instructor fails to fulfil, complete, or respect their confirmed booking obligations — including by cancelling bookings repeatedly without valid cause, failing to show up to a confirmed session, delivering a significantly shortened or materially different session than what was booked, or engaging in conduct during a session that results in a refund obligation to the User — Playdore reserves the right to:
- Place an immediate hold on the Instructor's pending payout for the affected booking(s), pending investigation of the non-fulfilment
- Deduct from the Instructor's payout any refund amounts that Playdore is required to issue to affected Users as a direct result of the Instructor's non-fulfilment
- Withhold the Instructor's payout partially or in full for a billing period if the volume or severity of non-fulfilment events in that period is assessed by Playdore as indicative of systematic unreliability or misconduct
- Permanently cancel a payout if the Instructor's account is terminated for cause related to booking non-fulfilment, fraud, or material breach of these Terms, after deducting all amounts owed to Playdore and refunds owed to Users
- Playdore will notify the Instructor before implementing a payout hold or deduction where reasonably practicable, and will provide a brief explanation of the basis for the action. Instructors may contest a payout hold by writing to hello@playdore.com within 7 days of notification. Playdore will review and respond within 14 days. During this review, the hold remains in place.
- TDS and Tax Compliance: Payouts are subject to applicable TDS obligations under Indian income tax law. Playdore will issue TDS certificates (Form 16A or equivalent) to Instructors as required. Instructors are solely responsible for their own income tax, GST, and other tax filings in respect of their earnings on the platform.
6.4 Instructor Plans & Platform Fees
In addition to per-booking commission, Playdore may offer, require, or make available various paid plans, subscription tiers, and onboarding packages for Instructors. These plans form part of the commercial relationship between Playdore and each Instructor and are subject to the following:
- Plan Availability: Playdore may from time to time introduce, modify, or discontinue paid plans for Instructors. Plans may include, but are not limited to: onboarding or listing activation fees, monthly or annual subscription plans, tiered visibility or feature plans (e.g., "Basic", "Pro", "Premium"), pay-per-lead or pay-per-click models, and promotional or featured listing packages.
- Plan Benefits: Different plans may confer different levels of platform access, listing visibility, promotional exposure, booking priority, analytics features, customer support priority, or commission rates. The specific benefits of each plan will be described in Playdore's plan documentation, as updated from time to time.
- Plan Fees: Fees for paid plans will be communicated to Instructors at the time the plan is offered or selected, and will be charged in advance (monthly or annually, as applicable). Plan fees are separate from booking commissions and are non-refundable once a billing period has commenced, except where required by applicable law.
- Changes to Plans: Playdore reserves the right to introduce new plans, modify existing plan features or pricing, or discontinue plans at any time, with advance notice to affected Instructors. Continuation of a plan after a pricing change takes effect constitutes acceptance of the new pricing.
- Plan as Condition of Listing: Playdore may, at its discretion, require Instructors to subscribe to a minimum plan tier as a condition of onboarding, maintaining a listing, or accessing certain platform features. Where this is the case, it will be clearly communicated to the Instructor before they are required to commit.
- Non-Payment: Failure to pay applicable plan fees may result in suspension of the Instructor's listing, reduction in visibility, or removal from the platform until outstanding amounts are settled.
6.5 Referral Program
Playdore may operate a referral program that allows Instructors to earn commission credits or waive-offs by referring new Learners to the platform. The specific terms, eligibility criteria, and benefits of the referral program are published in the Partnership Tiers document. Playdore reserves the right to modify, suspend, or discontinue the referral program at any time, with reasonable notice to participating Instructors. Any referral credits already earned prior to a program change will be honoured.
6.6 Failed Payments and Errors
If a payment fails due to a technical error on Playdore's platform, any amount debited from the User's account will be refunded within 5–7 business days. If you believe you have been incorrectly charged, contact us at support@playdore.com with your booking reference within 14 days of the transaction.
6.7 GST, Invoicing & Tax Responsibility — Marketplace Model
Playdore operates as a technology marketplace and payment intermediary, not as the provider of the underlying activity or class service. This distinction has direct implications for how GST applies to transactions made through the platform. This section explains those implications clearly for both Users and Instructors.
What Playdore charges GST on (Playdore's own taxable supplies):
Playdore is a GST-registered entity and charges GST on the services it directly provides to Users and Instructors. GST applies to:
- Platform Convenience Fee (charged to Users): The convenience fee charged per booking is Playdore's own service charge for providing the platform, discovery, payment processing, and booking infrastructure. GST at the prevailing applicable rate is levied on this fee and is Playdore's own tax liability. Playdore will issue a GST-compliant receipt or invoice for this charge.
- Platform Commission (charged to Instructors): The commission that Playdore deducts from an Instructor's payout is consideration for Playdore's marketplace services provided to the Instructor. GST at the prevailing applicable rate is levied on this commission. Playdore will issue a GST-compliant invoice to the Instructor for the commission amount, which Instructors (if registered) may claim as input tax credit (ITC) subject to applicable GST rules.
- Plan and subscription fees (charged to Instructors): Any paid plan fees, listing activation fees, or subscription charges paid by an Instructor to Playdore are subject to GST at the prevailing applicable rate. Playdore will issue invoices for these charges.
GST on the Class / Session Fee (Instructor's taxable supply):
The Class / Session Fee — the price charged by an Instructor for their activity or service — represents the Instructor's own supply of services to the User, not Playdore's supply. Playdore collects this amount as a payment intermediary on behalf of the Instructor. The GST treatment of the class fee depends on the Instructor's GST registration status:
- Instructors below the GST threshold (not GST-registered): If an Instructor's aggregate annual turnover from all taxable supplies of services does not exceed the applicable GST registration threshold (currently ₹20 lakhs per annum for most states; ₹10 lakhs per annum for Special Category States as notified under the CGST Act), the Instructor is not required to register for or collect GST on their class fees. In such cases, no GST is charged on the class fee component of the booking, and the amount displayed as the class fee is the final price for the Instructor's service. No GST invoice for the class fee will be issued in this case.
- GST-registered Instructors — collection by Playdore on Instructor's behalf: Where an Instructor has registered for GST (whether mandatory or voluntary) and has provided a valid GSTIN to Playdore, the following applies:
- Playdore will collect GST on the class fee from the User at the applicable rate (typically 18% for general coaching/training services, though rates may differ by activity category) on behalf of the Instructor, as part of the total booking amount charged at checkout.
- Playdore will issue a GST-compliant invoice to the User on behalf of the Instructor for the class fee component, displaying the Instructor's GSTIN, the applicable GST rate, and the GST amount. This invoice is issued by Playdore in its capacity as a billing intermediary — the underlying taxable supply remains the Instructor's.
- Playdore will remit the full class fee amount including the GST collected to the Instructor as part of the Instructor's payout (subject to deductions for Commission, TDS, and any other amounts owed under these Terms).
- The Instructor is solely responsible for remitting the GST amount to the government. Upon receiving the payout (which includes the GST collected from Users), the Instructor must account for and remit the GST component to the appropriate government authority in accordance with the CGST Act and applicable State GST laws. Playdore's role is limited to collecting and passing through the GST amount — Playdore does not file GST returns, claim input tax credit, or bear any liability for the GST on the Instructor's class fee.
- Instructor's responsibility regardless of registration status: Whether or not GST is collected by Playdore on the Instructor's behalf, the Instructor remains solely responsible for: (a) correctly determining whether they are required to register for GST; (b) registering for GST when required by law; (c) ensuring the correct GST rate is applied to their services; (d) filing their own GST returns (GSTR-1, GSTR-3B, and any other applicable returns); and (e) remitting all GST collected on their services to the government within the prescribed timelines.
- Playdore's non-liability: Playdore will not be held liable for any GST shortfall, underpayment, interest, penalty, or regulatory action arising from an Instructor's failure to: register for GST when required, correctly determine the applicable GST rate, remit GST collected to the government, or file returns on time. This is entirely the Instructor's statutory obligation. Playdore's collection of GST on the Instructor's behalf is a facilitation service and does not transfer any of the Instructor's tax compliance obligations to Playdore.
Invoicing structure for Users:
When a User completes a booking, they will receive a booking receipt or invoice that includes:
- Class / Session Fee: The Instructor's service charge. Where the Instructor is GST-registered, a GST-compliant invoice will be issued on behalf of the Instructor, showing the Instructor's GSTIN, the class fee amount, the applicable GST rate, and the GST amount. Where the Instructor is not GST-registered, the class fee will be shown without GST.
- Platform Convenience Fee + applicable GST: Playdore's own taxable supply, for which Playdore is the tax-issuing entity. Playdore's GSTIN and GST details will be shown for this component.
The booking invoice may therefore contain two distinct tax components — one for the Instructor's supply (where applicable) and one for Playdore's own platform charges. Users who require a formal GST invoice for input tax credit (ITC) purposes should ensure their billing details are accurate at the time of booking.
Instructor obligations regarding GST disclosure:
Instructors are responsible for:
- Accurately determining and disclosing whether their listed class prices are inclusive or exclusive of GST
- Providing their GSTIN to Playdore during onboarding if they are GST-registered, and updating it promptly if their registration status changes (e.g., if they cross the threshold and register mid-year)
- Notifying Playdore immediately if their GSTIN is cancelled, suspended, or surrendered, so that GST collection on their behalf can be stopped
- Ensuring the GST rate applicable to their services is correctly communicated to Playdore — Playdore will apply the rate as indicated by the Instructor and is not responsible for verifying rate accuracy
- Filing their own GST returns and remitting all GST collected (including amounts collected by Playdore on their behalf and passed through in their payout) to the appropriate government authority within prescribed timelines
- Reconciling GST amounts received from Playdore with their own GST filings
Playdore reserves the right to request proof of an Instructor's GST registration or exemption status as part of onboarding or at any point during the relationship. Failure to provide accurate GST information may result in: (a) GST not being collected on the Instructor's behalf; (b) invoices being issued without the Instructor's GST details; or (c) suspension of Listings until accurate information is provided. An Instructor who provides a false or invalid GSTIN to Playdore shall be solely liable for all consequences, including any tax demand, interest, or penalty arising from incorrect invoicing.
7. Cancellations, No-Shows & Refunds
7.1 Instructor-Set Cancellation Policies
Each Instructor sets their own cancellation policy, which is displayed on their listing page and confirmed at the time of booking. Users are responsible for reading and understanding an Instructor's cancellation policy before confirming a booking. Playdore enforces these policies as agreed between the User and Instructor at the time of booking.
7.2 User-Initiated Cancellations
- Refunds for User-initiated cancellations are governed by the Instructor's stated cancellation policy at the time of booking.
- If no cancellation policy is specified on the Instructor's listing, Playdore's default cancellation policy applies: cancellations made more than 24 hours before the scheduled session start time are eligible for a full refund of the class fee; cancellations within 24 hours of the session are non-refundable.
- The platform convenience fee (Section 6.2) is non-refundable in all User-initiated cancellations, unless the cancellation results from a verified Playdore system error.
7.3 Instructor-Initiated Cancellations
- If an Instructor cancels a confirmed booking, the User is entitled to a full refund of the class fee and the platform convenience fee.
- Repeated Instructor cancellations may result in a review of the Instructor's listing, reduced visibility, or suspension from the platform at Playdore's discretion.
- In the event of an Instructor cancellation, Playdore will notify the User as soon as practicable and initiate the refund process.
7.4 No-Show Policy
A "no-show" occurs when a User fails to attend a confirmed booking without cancelling in advance. The no-show policy — including whether any refund is applicable in such a circumstance — is governed by the Instructor's stated cancellation policy. Where an Instructor's policy does not explicitly address no-shows, a no-show shall be treated as a last-minute cancellation and the User shall not be entitled to a refund of the class fee. Playdore's specific platform-wide no-show policy, if and when adopted, will be published separately and communicated to Users in advance.
7.5 Rescheduling
Requests to reschedule a confirmed booking are subject to the Instructor's availability and agreement. Rescheduling is not guaranteed and is at the Instructor's discretion. If a User wishes to reschedule, they should contact the Instructor through the Playdore messaging system as early as possible. Playdore is not responsible for arranging or facilitating rescheduling and shall not be liable if a rescheduling request cannot be accommodated.
7.6 Refund Processing
Where a refund is due, it will be processed to the original payment method within 5–10 business days of the refund being approved. Processing times may vary depending on the payment gateway and the User's bank. The platform convenience fee, where non-refundable, will be deducted from any refund amount issued.
7.7 Dispute Resolution for Bookings
If a User or Instructor has a dispute relating to a booking, cancellation, or refund, they should first attempt to resolve the matter directly through the Playdore messaging system. If a resolution cannot be reached, either party may contact Playdore's support team at support@playdore.com. Playdore may, at its sole discretion, intervene and issue a refund or take other remedial action where it determines this to be appropriate. Playdore's decision in such disputes shall be final and binding for the purposes of the booking in question.
8. Injury, Risk & Liability Waiver
This section is important. Please read it carefully before booking any physical activity.
8.1 Acknowledgement of Inherent Risk
Physical activities — including but not limited to sports, fitness training, dance, yoga, martial arts, swimming, gymnastics, outdoor activities, and wellness practices — inherently carry a risk of physical injury. These risks include, but are not limited to, muscle strains and tears, ligament injuries, fractures, dislocations, concussions, cardiovascular events, and in extreme cases, permanent disability or death. By booking and attending any activity through Playdore, each User (and each Guardian on behalf of a child) expressly:
- Acknowledges that they are aware of the inherent risks associated with the chosen activity
- Accepts and assumes all such risks voluntarily and knowingly
- Confirms that they (or the child they are booking for) are physically capable of participating in the chosen activity
- Understands that Playdore has not assessed their physical condition or the suitability of the activity for them
8.2 Voluntary Participation
Participation in any activity booked through Playdore is entirely voluntary. No User or Guardian is compelled to participate. By completing and paying for a booking, the User or Guardian confirms that they are choosing to participate (or to allow their child to participate) freely and with informed awareness of the risks involved.
8.3 Playdore's Non-Liability for Injury
To the fullest extent permitted by applicable law, Playdore shall not be liable for:
- Any personal injury, illness, physical harm, psychological harm, or death arising from participation in any activity booked through the platform, whether caused by the Instructor's actions, the User's own actions, or the actions of any third party present at the session
- Any injury or harm arising from the User's failure to follow instructions given by the Instructor during a session
- Any injury or harm arising from the User's failure to disclose relevant medical conditions, physical limitations, or health information to the Instructor prior to the session
- Any harm resulting from activities that exceed the User's or child's physical or developmental capabilities
- Any injury arising from the condition of the venue or facilities used by the Instructor (which are the Instructor's responsibility, not Playdore's)
8.4 Instructor Responsibility for Conduct
Instructors are solely responsible for:
- The safe delivery of their services, including appropriate warm-up, technique instruction, and session management
- Maintaining a safe environment at the venue or location where their sessions take place
- Adapting sessions to the physical condition, age, and ability of participants, where reasonably practicable and where they have been notified of relevant information
- Ensuring that the activities they offer do not pose unreasonable or undisclosed risks to participants
- Complying with all applicable safety standards, regulations, and professional codes of conduct relevant to their field
Playdore does not supervise, observe, or monitor any session and cannot guarantee that Instructors comply with the above responsibilities. Users and Guardians are encouraged to raise any safety concerns with Playdore at support@playdore.com.
8.5 Medical Clearance Recommendation
Users are strongly advised to consult a qualified medical professional before undertaking any new physical activity, particularly if they have a pre-existing medical condition, are pregnant, are over 50, or have been physically inactive for an extended period. Playdore does not provide medical advice and cannot assess whether any activity is suitable for any individual's health condition.
9. Anti-Circumvention
9.1 The Anti-Circumvention Obligation
Playdore invests significantly in building and maintaining the platform, providing discovery, booking infrastructure, payment processing, and trust and safety systems that facilitate connections between Users and Instructors. As a condition of using Playdore, both Users and Instructors expressly agree not to circumvent, bypass, or undermine the Playdore platform for any booking, transaction, or ongoing engagement that originated through or was facilitated by Playdore.
9.2 Prohibited Circumvention Activities
The following actions constitute circumvention and are expressly prohibited:
- Arranging, confirming, or paying for any booking, session, class, or service directly with an Instructor (outside the Playdore platform) if the connection between the User and that Instructor was originally made through Playdore
- Soliciting or accepting an Instructor's personal payment details, private contact information, or external booking links for the purpose of transacting outside the platform
- Instructors accepting direct payment from a User for any session or service that was initially discovered, introduced, or booked through Playdore
- Encouraging, facilitating, or agreeing to circumvent the platform in any communication, whether through Playdore's messaging system or externally
- Creating a new account on Playdore after suspension specifically to circumvent this restriction
9.3 Consequences of Circumvention
Playdore takes anti-circumvention seriously as it directly undermines the platform's sustainability and the trust and safety systems that protect all users. Violation of this section may result in:
- Immediate suspension or permanent termination of the User's and/or Instructor's account without refund of any balance or pending payouts
- A circumvention fee charged to the Instructor equal to Playdore's standard commission rate applied to the estimated value of the off-platform transactions, to compensate Playdore for lost revenue
- Legal action to recover damages where the circumvention has caused material financial harm to Playdore
9.4 Reporting
If you are approached by an Instructor or User suggesting you transact outside the platform, please report this to us at support@playdore.com. Reports made in good faith will be treated confidentially.
10. Code of Conduct
Playdore is built on trust between learners, instructors, and the platform. All users — whether Learners or Instructors — are expected to conduct themselves with honesty, respect, and responsibility at all times while using the platform and while participating in any activity facilitated through it. This Code of Conduct sets out the standards we require and the consequences for violations.
10.1 General Obligations — All Users
All users of Playdore agree to:
- Use the platform only for lawful purposes and in full compliance with all applicable Indian laws and regulations, including the Information Technology Act, 2000, Consumer Protection Act, 2019, and any other applicable legislation
- Provide accurate, truthful, and up-to-date information in all interactions on the platform, including registration, profiles, listings, bookings, reviews, and communications
- Treat all other users — whether Learners, Instructors, or Playdore staff — with dignity, courtesy, and respect
- Not engage in any communication, action, or behaviour that could reasonably be expected to harm, offend, intimidate, or endanger any other person
10.2 Anti-Harassment Policy
Playdore has a zero-tolerance policy for harassment in any form. The following conduct is strictly prohibited and constitutes a violation of this Code:
- Verbal or written harassment: Sending messages, reviews, or communications that are abusive, threatening, sexually explicit, personally degrading, or designed to cause distress to any person
- Unwanted contact: Persisting in contacting another user after they have asked you to stop, or attempting to contact a user through external channels without their consent
- Stalking or surveillance: Following, monitoring, or tracking another user's physical movements, online activity, or location without their consent
- Sexual harassment: Making unwanted sexual advances, comments, or requests — whether in messages, in person during sessions, or in any other context arising from a Playdore interaction
- Bullying: Repeated conduct designed to intimidate, belittle, embarrass, or coerce another person into acting against their interests
Any user who experiences harassment through the platform should report it immediately at support@playdore.com. Playdore will investigate all reports promptly and take appropriate action, which may include suspension or permanent removal of the offending account.
10.3 Non-Discrimination Policy
Playdore is committed to providing an inclusive platform free from discrimination. No user — whether Learner or Instructor — may refuse to serve, engage with, or interact with another user on the platform on the basis of:
- Race, ethnicity, caste, or national origin
- Religion or religious beliefs
- Gender identity or sexual orientation
- Age, disability, or physical appearance
- Socioeconomic background or language
- Any other characteristic protected under applicable Indian law, including the Constitution of India
Instructors may not decline bookings from users based on any of the above characteristics. Users may not direct discriminatory conduct or language at Instructors or other users. Violations of this policy may result in permanent account removal and may be referred to the appropriate legal authorities.
10.4 Safe Conduct Obligations
Particularly in the context of physical activity sessions, all users agree to:
- Not engage in any conduct that poses an unreasonable risk of physical harm to themselves or others during a session
- Follow all safety instructions provided by the Instructor during a class or session
- Not attend any session while under the influence of alcohol, drugs, or any substance that impairs their physical or cognitive ability to participate safely
- Not bring weapons, dangerous objects, or prohibited substances to any session venue
- Disclose relevant health conditions to the Instructor before a session, particularly where those conditions could affect the safety of the session for the user or others
- Not encourage or pressure other participants — including children — to engage in activities that exceed their physical capacity or that they have expressed reluctance to perform
Instructors are additionally required to maintain a safe physical environment at any venue they use for Playdore sessions, to hold current applicable professional insurance where required by their field, and to stop any session and seek assistance immediately if a medical emergency or safety incident occurs.
10.5 Prohibited Platform Behaviour
All users agree not to:
- Post false, misleading, fraudulent, or defamatory content anywhere on the platform, including listings, reviews, profiles, or messages
- Impersonate any person or entity, or misrepresent their identity, credentials, or affiliation
- Scrape, copy, reproduce, or systematically download Playdore's content, listings, or database by any automated or manual means
- Upload or transmit malicious code, viruses, spyware, or any software that interferes with the platform's functionality or compromises user data
- Attempt to gain unauthorised access to any part of the platform, to other users' accounts, or to Playdore's backend systems
- Use the platform to send spam, unsolicited marketing communications, chain messages, or phishing attempts to other users
- Engage in any activity that places an unreasonable or disproportionate burden on Playdore's infrastructure
- Use the platform to promote or facilitate any illegal activity, including but not limited to gambling, drug use, money laundering, or human trafficking
10.6 Enforcement and Consequences
Playdore reserves the right to investigate any suspected violation of this Code of Conduct and to take action at its sole discretion. Depending on the severity and nature of the violation, enforcement action may include:
- Warning: A formal written warning sent to the user's registered email address
- Content removal: Removal of listings, reviews, messages, or other content that violates this Code
- Temporary suspension: Temporary restriction of the user's account access pending investigation or as a proportionate response to a less severe violation
- Permanent termination: Immediate and permanent closure of the user's account, without refund of any balance, in cases of serious, repeated, or irredeemable violations — including harassment, discrimination, unsafe conduct, or illegal activity
- Legal referral: Reporting of conduct to law enforcement authorities and/or civil legal action where the conduct constitutes a criminal offence or causes significant harm to Playdore or another user
Where an account is terminated for Code of Conduct violations, Playdore is not obligated to provide detailed reasons for the termination and shall not be liable for any loss suffered by the user as a consequence of the termination. Users who believe their account has been suspended or terminated in error may appeal by writing to support@playdore.com.
11. Content & Intellectual Property
When Instructors upload photos, videos, descriptions, or other content to their listings or profiles, they:
- Represent and warrant that they own or have the right to use such content and that it does not infringe any third-party intellectual property rights
- Grant Playdore a non-exclusive, royalty-free, worldwide, sublicensable licence to display, reproduce, adapt, and use that content for the purpose of operating, promoting, and marketing the platform for as long as the listing is active or as otherwise agreed
Playdore's logo, brand name, software, platform design, proprietary algorithms, and all other content created by Playdore are owned exclusively by Playdore and protected by applicable intellectual property laws. They may not be used, reproduced, or distributed without Playdore's prior written permission.
12. Promotions, Marketing Campaigns & Collaborative Content
12.1 Playdore-Initiated Promotional Activities
Playdore may, from time to time, plan, organise, or participate in promotional activities, marketing campaigns, events, activations, or experiential initiatives ("Promotional Activities") that may involve Instructors, their premises, venues, Listings, or brand. These activities are part of Playdore's efforts to grow awareness of the platform, drive Learner engagement, and promote the offerings of Instructors listed on the platform.
Promotional Activities may include, but are not limited to:
- On-ground promotional events, activations, trial sessions, open days, or discovery workshops at Instructor venues
- Seasonal campaigns, festival-themed promotions, or category-specific marketing drives
- Pop-up events, community meetups, or multi-instructor showcases
- Co-branded events or collaborations involving Playdore and one or more Instructors
12.2 Prior Approval
Playdore will not conduct any Promotional Activity at or involving an Instructor's premises, venue, brand name, or Listings without obtaining the Instructor's prior approval. Approval may be obtained through email, the Platform's messaging system, or any other documented and verifiable communication channel. Once approval is granted, the Instructor agrees to cooperate reasonably with Playdore in the execution of the Promotional Activity.
12.3 Social Media and Digital Promotion
Playdore may create, produce, and publish digital content — including social media posts, reels, stories, videos, graphics, blog articles, and other marketing material — featuring Instructors, their Listings, venues, or classes for the purpose of promoting both the Platform and the Instructor's services. With the Instructor's prior approval, Playdore may also:
- Post content on behalf of Instructors on their social media accounts or channels
- Create and publish collaborative or co-branded content with Instructors
- Arrange photography or videography at Instructor venues or during sessions for use in marketing materials
Content created by Playdore in connection with Promotional Activities is owned by Playdore unless otherwise agreed. Instructors are granted a non-exclusive, royalty-free licence to repost or share such content on their own channels. Instructors may request removal or modification of any content they believe misrepresents their services.
12.4 No Additional Financial Entitlement
Unless expressly stated otherwise in writing (via email or other documented communication), no additional financial compensation, fees, royalties, revenue share, or non-financial benefits (such as guaranteed bookings, increased visibility, or preferential ranking) are owed to an Instructor for participation in any Promotional Activity, marketing campaign, social media content creation, or collaborative content arrangement. Promotional Activities are conducted for the mutual benefit of the Platform and the Instructor's visibility. If Playdore and an Instructor separately agree on specific financial or other consideration for a particular promotion, such terms must be documented in writing and will prevail over this general provision for that specific activity.
12.5 Campaign Variability
Playdore reserves the right to plan, launch, modify, pause, or discontinue any Promotional Activity or campaign at any time, at its sole discretion. The nature, frequency, scope, and format of campaigns may vary based on Playdore's marketing strategy, seasonal demand, category focus, and available resources. Playdore is not obligated to include any specific Instructor in any Promotional Activity. Instructors retain the right to decline participation in any specific promotion without penalty to their account or listing visibility.
12.6 Third-Party Promotions
Playdore may partner with third-party brands, sponsors, or organisations for joint promotional campaigns involving Instructors. In such cases, Playdore will obtain the Instructor's prior approval before featuring them in any third-party branded content. The Instructor's name, likeness, or brand will not be associated with any third party without their consent. Unless separately agreed in writing, no additional compensation from the third party or from Playdore is owed to the Instructor for such participation.
12.7 Liability
Playdore shall take reasonable care in the planning and execution of Promotional Activities. However, Playdore shall not be liable for any damage, loss, or disruption to an Instructor's premises, equipment, or business operations arising from a Promotional Activity, except where caused by Playdore's own gross negligence or wilful misconduct. Both parties agree to conduct all Promotional Activities in compliance with applicable laws, including advertising standards, consumer protection regulations, and local requirements.
13. Reviews & Ratings
Users may leave reviews for Instructors after a completed booking. By submitting a review, you confirm that:
- The review is based on your genuine, first-hand experience of the session
- The review does not contain offensive, defamatory, discriminatory, or false content
- You have not received any payment, incentive, or reward (from Playdore, the Instructor, or any third party) in exchange for writing a positive review
Playdore reserves the right to remove any review that violates these guidelines. Instructors may not offer incentives for positive reviews or threaten or intimidate Users into removing negative reviews — doing so is a violation of these Terms and may result in account suspension.
14. Disclaimer of Warranties
Playdore is provided "as is" and "as available" without any representation or warranty of any kind, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Any warranty that the platform will be error-free, uninterrupted, secure, or free from viruses or harmful components
- Any warranty that search results, recommendations, or discovery algorithms will produce accurate, complete, or relevant results for any particular User
- Any warranty that any Instructor listed on the platform will meet a User's expectations, skill requirements, or quality standards
- Any warranty that a booking, once made, will be honoured by the Instructor
Playdore makes no representation that the platform or its content is appropriate or available for use in any particular jurisdiction outside India. Access to the platform from jurisdictions where its content is illegal is prohibited.
15. Limitation of Liability
15.1 Excluded Losses
To the maximum extent permitted by applicable law, Playdore, its directors, officers, employees, affiliates, agents, and licensors shall not be liable for any:
- Indirect, incidental, special, punitive, or consequential damages of any kind
- Loss of profit, revenue, business, goodwill, data, or opportunity
- Injury, illness, death, or property damage arising from participation in any activity booked through the platform
- Conduct, actions, omissions, misconduct, or negligence of any Instructor or User
- Interruption, unavailability, delay, or failure of the platform or any third-party service integrated with it
- Unauthorised access to or alteration of your transmissions or data
- Any matter beyond Playdore's reasonable control
15.2 Liability Cap
Notwithstanding any other provision of these Terms, Playdore's total aggregate liability to any User or Instructor for any and all claims arising out of or in connection with these Terms or the use of the platform shall not exceed the total amount paid by that User or Instructor to Playdore in the three (3) calendar months immediately preceding the event giving rise to the claim. This cap applies regardless of the form of action — whether in contract, tort, statute, or otherwise — and applies to the aggregate of all claims, not each individual claim separately.
15.3 Exceptions
Nothing in these Terms excludes or limits Playdore's liability for: (a) death or personal injury caused by Playdore's own proven gross negligence or wilful misconduct; (b) fraud or fraudulent misrepresentation by Playdore; or (c) any other liability that cannot be excluded or limited under applicable Indian law. The limitations set out in this section reflect a fair allocation of risk between the parties and are a fundamental basis of the agreement between you and Playdore.
16. Indemnification
16.1 User and Instructor Indemnity
You agree to indemnify, defend, and hold harmless Playdore and its directors, officers, employees, affiliates, agents, licensors, and service providers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and disbursements) arising out of or in connection with:
- Your use of, or inability to use, the Playdore platform
- Your violation of any provision of these Terms or our Privacy Policy
- Your violation of any applicable law, regulation, or third-party right (including intellectual property rights, privacy rights, or consumer rights)
- Any booking you make or service you provide through the platform, including any injury, damage, or dispute arising from a session
- Any content you upload, submit, or transmit through the platform, including false or misleading content
- Any wilful misconduct, negligence, or wrongful act committed by you, or by any child or person on whose behalf you have made a booking
- Any payment dispute, chargeback, or fraudulent transaction initiated or facilitated by you
- Any circumvention of the platform's payment or booking systems in violation of Section 9
- Any claim by a third party arising from your actions or omissions while using the platform
16.2 Instructor-Specific Indemnity
In addition to the above, Instructors agree to indemnify Playdore for any claim arising from:
- Inaccurate, misleading, or fraudulent representations made in their Playdore profile or listing
- Failure to hold required professional qualifications, licences, or insurance for the services they offer
- Any injury to a User or child arising from the Instructor's conduct, negligence, or failure to maintain a safe environment during a session
- Tax or regulatory non-compliance by the Instructor in respect of their earnings on the platform
16.3 Process
Playdore will provide you with prompt notice of any claim for which indemnification is sought and will cooperate reasonably with your defence of such claim. Playdore reserves the right to assume exclusive control of the defence of any matter otherwise subject to indemnification by you, at your expense, in which case you agree to cooperate with Playdore's defence.
17. Dispute Resolution & Governing Law
17.1 Governing Law
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by and shall be construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
17.2 Informal Resolution First
Before initiating any formal dispute process, both parties agree to make a good faith attempt to resolve any dispute informally. The aggrieved party shall notify Playdore in writing at hello@playdore.com with a description of the dispute and the remedy sought. The parties will attempt to resolve the matter within 30 days of receipt of such notice. Either party may proceed to formal dispute resolution if no resolution is reached within this period.
17.3 Arbitration
If the dispute cannot be resolved informally within the 30-day period, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be:
- Conducted by a sole arbitrator mutually agreed upon by both parties, or, failing agreement within 15 days, appointed by the relevant authority under the Act
- Seated and conducted in Mumbai, Maharashtra, India
- Conducted in the English language
- Subject to the Indian Arbitration and Conciliation Act, 1996 and any amendments thereto
The arbitrator's award shall be final and binding on both parties and may be enforced in any court of competent jurisdiction.
17.4 Court Jurisdiction (for Interim Relief)
Notwithstanding the arbitration clause above, either party may apply to a court of competent jurisdiction for urgent interim or injunctive relief to preserve rights pending arbitration. For this purpose, both parties irrevocably submit to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
17.5 No Class Actions
All disputes must be brought in the parties' individual capacities and not as a plaintiff or class member in any purported class, collective, or representative action or proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
18. Force Majeure
18.1 Definition
A "Force Majeure Event" means any event or circumstance beyond the reasonable control of Playdore or an Instructor that prevents or delays the performance of their respective obligations under these Terms. Force Majeure Events include, but are not limited to:
- Natural events: Floods, earthquakes, cyclones, storms, extreme weather conditions (including heavy rainfall, heatwaves, or air quality emergencies), lightning, or other acts of nature that render it unsafe or impossible to conduct an outdoor or in-person session
- Government and regulatory action: Any law, ordinance, order, regulation, directive, or restriction imposed by a governmental authority, including lockdowns, curfews, venue closures, public health emergency declarations, or restrictions on public gatherings under any applicable law (including the Disaster Management Act, 2005, or similar)
- Public health emergencies: Epidemics, pandemics, quarantine requirements, or health advisories issued by government bodies (such as the Ministry of Health, ICMR, or WHO) that prevent or restrict in-person activity
- Civil unrest: Riots, strikes, protests, acts of terrorism, or civil disturbances that make it unsafe to travel to or conduct sessions at a particular location
- Infrastructure failures: Failures of power, internet, telecommunications, or third-party service providers (including payment gateways) that are beyond Playdore's reasonable control
- Venue closure: Unplanned or mandatory closure of a session venue by the venue owner, a government authority, or due to any other Force Majeure Event
18.2 Playdore's Obligations in a Force Majeure Event
If a Force Majeure Event affects Playdore's ability to operate the platform or provide its services:
- Playdore will notify affected users as soon as reasonably practicable via email or in-app notification
- Playdore's obligations under these Terms will be suspended for the duration of the Force Majeure Event
- Playdore will not be liable for any loss, delay, or failure to perform its obligations to the extent such loss, delay, or failure is caused by the Force Majeure Event
- Playdore will make reasonable efforts to restore normal platform operations as soon as the Force Majeure Event has passed or sufficiently subsided
18.3 Instructor Cancellations Due to Force Majeure
Where an Instructor cancels or is unable to deliver a confirmed session due to a Force Majeure Event (for example, due to extreme weather making an outdoor venue unsafe, or due to a government-mandated closure of their facility):
- The Instructor shall notify Playdore and the affected User as soon as possible through the platform's communication tools
- The affected User will be offered a full refund of the class fee. The platform convenience fee may, at Playdore's discretion, be refunded or retained as a credit, depending on the circumstances
- Playdore will not penalise or reduce the visibility of an Instructor whose cancellation is verified to have been caused by a genuine Force Majeure Event
- Instructors remain responsible for proactively communicating Force Majeure cancellations — failure to notify users in a timely manner is not covered by this clause
Important for outdoor and weather-sensitive activities: Users who book outdoor sports, adventure activities, or weather-dependent classes acknowledge that such activities are particularly susceptible to Force Majeure Events, including adverse weather. By booking such activities, Users accept that cancellations due to weather or safety concerns are a foreseeable possibility and agree that Playdore shall bear no liability for such cancellations beyond facilitating an appropriate refund.
18.4 Duration and Termination
If a Force Majeure Event continues for more than 30 consecutive days and prevents the meaningful operation of a booking or a series of bookings, either party (the User, the Instructor, or Playdore) may elect to cancel the affected booking(s) with a full refund to the User, without further liability to any party.
19. Digital Communications Consent
19.1 Consent to Receive Communications
By creating an account on Playdore and accepting these Terms, you expressly consent to receive communications from Playdore and, where applicable, from Instructors through the following channels, for the purposes described below:
- Email: Booking confirmations, receipts, session reminders, account-related notifications, policy updates, and service communications
- SMS (text messages): Booking confirmations, session reminders, OTPs (one-time passwords) for account security, and urgent account or safety notifications
- Push notifications (in-app): Real-time booking updates, session reminders, messages from Instructors, promotional discoveries (e.g., new classes nearby), platform announcements, and safety or emergency alerts
- WhatsApp (where opted in): If you explicitly opt in to WhatsApp communications through your account settings or at the time of booking, Playdore may send you booking confirmations, session reminders, and support-related messages via WhatsApp. WhatsApp communications will only be sent if you have separately provided consent and will be governed by WhatsApp's terms and Meta's privacy policy in addition to Playdore's
19.2 Transactional vs. Promotional Communications
Playdore distinguishes between two types of communications:
- Transactional communications are messages necessary for the operation of the platform and your use of its services — including booking confirmations, payment receipts, password resets, account security alerts, and safety notifications. These messages are sent regardless of your marketing preferences and cannot be fully opted out of while your account remains active, as they are essential to service delivery.
- Promotional communications include marketing messages, newsletters, new feature announcements, special offers, and suggested classes or Instructors based on your interests. You may opt out of promotional communications at any time through your account notification settings or by using the "unsubscribe" link included in any marketing email.
19.3 Compliance with Indian Telecom Regulations
All SMS communications sent by Playdore comply with the Telecom Commercial Communications Customer Preference Regulations (TCCCPR) issued by the Telecom Regulatory Authority of India (TRAI). Playdore will only send SMS messages through registered telemarketing headers and within the categories for which consent has been obtained. You may register your preference on the National Do Not Call (NDNC) registry operated by TRAI; however, transactional messages (as defined above) may still be delivered to registered numbers as permitted under TRAI regulations.
19.4 Managing Your Communication Preferences
You have control over the communications you receive from Playdore:
- Push notifications: Can be enabled or disabled at any time through your device settings (iOS: Settings → Notifications → Playdore; Android: Settings → Apps → Playdore → Notifications) or through your Playdore app notification settings
- Email marketing: Can be opted out of via the "unsubscribe" link at the bottom of any marketing email, or through your account preferences page
- SMS marketing: Can be opted out of by replying "STOP" to any promotional SMS from Playdore, or by updating your notification preferences in the app
- WhatsApp: Can be opted out of at any time through your account settings. Opting out of WhatsApp communications does not affect your ability to use the platform
Opting out of promotional communications will not affect transactional messages required for your bookings and account security. Processing your opt-out request may take up to 7 business days, during which you may continue to receive communications already scheduled for delivery.
19.5 Third-Party and Instructor Communications
Playdore may share your contact details (name and phone number or email) with an Instructor after a confirmed booking to facilitate session-specific communication — for example, location directions, session updates, or cancellation notices. By accepting a booking, you consent to this sharing. Instructors are not permitted to use your contact information for unsolicited marketing or for any purpose unrelated to the confirmed booking. If you receive unwanted communications from an Instructor, please report it to support@playdore.com.
20. Changes to These Terms
Playdore may update or modify these Terms from time to time to reflect changes in our business, legal requirements, or platform features. We will provide at least 7 days' advance notice of any material changes via email or in-app notification. The updated Terms will be posted on the platform with a revised "Last updated" date. Your continued use of Playdore after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the platform before they take effect.
